合同翻譯中的正式用語(yǔ)

在合同翻譯中有很多正式用語(yǔ)，正式用語(yǔ)的翻譯，能夠避免合同內(nèi)容的歧義性，也是體現(xiàn)合同專業(yè)性和嚴(yán)謹(jǐn)性的一種方案，相比于口頭用語(yǔ)，合同翻譯的正式書(shū)面用語(yǔ)，也體現(xiàn)出了合同對(duì)簽訂雙方的權(quán)利和義務(wù)，做為合同翻譯工作人員，要通曉并在翻譯中使用正式用語(yǔ)。

根據(jù)合同內(nèi)容的特點(diǎn)，合同多采用書(shū)面的形式書(shū)寫(xiě)，詞匯使用方面使用都是正式的書(shū)面用語(yǔ)，較少使用口頭用語(yǔ)，以顯示合同正規(guī)、嚴(yán)肅。具體實(shí)例如下：

At the request of Party B, Party A agrees to send technicians to assist Party B to install the equipment. 應(yīng)乙方要求，甲方同意派遣技術(shù)人員幫助乙方安裝設(shè)備。

在這段合同內(nèi)容翻譯中assist 較 help 正式；

The personnel shall not to partake in any political activities in Iraq.所有人員不得參加伊拉克國(guó)內(nèi)的任何政治活動(dòng)。

相比之下，在合同翻譯里partake in 較 take part in 正式；

The Employer shall render correct technical guidance to the personnel.雇主應(yīng)該對(duì)有關(guān)人員給予正確技術(shù)指導(dǎo)。 從這里可以看出render 較 give 正式；

Party A shall repatriate the patient to China and bear the cost of his passage to Guangzhou.甲方應(yīng)將病人遣返中國(guó)并負(fù)責(zé)其返回廣州的旅費(fèi)。

合同翻譯方面repatriate 較 send back 正式；

This Contract shall be governed by and construed in accordance with the laws of China.本合同受中國(guó)法律管轄，并按中國(guó)法律解釋。

這里construe 較 explain, interpret 正式；in accordance with 較 according to 正式。

The Employer may object to and require the Contractor to replace forthwith any of its authorized representatives who is incompetent.雇主認(rèn)為承包人委派的授權(quán)代表不合格時(shí)，可以反對(duì)并要求立即撤換。

從這段內(nèi)容中，不難看出，合同翻譯方面require 較 ask 正式；而且，require 表示上對(duì)下的要求，ask 沒(méi)有這么明確，它含有 request 和 require之意，其中 request 表示下對(duì)上的要求，即"請(qǐng)求"公文體 forthwith 較 at once 正式；

The Chairperson may convene and preside an interim meeting based on a proposal made by one-third of the total number of directors.董事長(zhǎng)可以根據(jù)董事會(huì)過(guò) 1/3 董事的提議而召集主持臨時(shí)董事會(huì)議。

從嚴(yán)謹(jǐn)性方面，可以看出Convene 較 hold 正式，preside 較 be in charge of 正式，interim 也是正式用詞較 temporary 正式。

In processing transactions, the manufacturers shall never have title either to the materials or the finished

products.加工貿(mào)易中，廠方無(wú)論是對(duì)原料還是成品都無(wú)所有權(quán)。

這里title 較 ownership 正式。

The term "Effective date" means the date on which this Agreement is duly executed by the parties

hereto."生效期"指雙方合同簽字的日子。 這里execute 較 sign 正式；

最后這段合同內(nèi)容在翻譯方面也是采用正式用語(yǔ)的方式進(jìn)行表達(dá)：

The submission to and consent by the Engineer of such programs or the provision of such general descriptions or cash flow estimates shall not relieve the Contractor of any of his duties or responsibilities under the Contract.向工程師提交并同意的上述進(jìn)度計(jì)劃或提供上述一般說(shuō)明或現(xiàn)金流量估算，并不解除合同規(guī)定的承包人的任何義務(wù)或責(zé)任。

在這里可以看出Consent 和 estimate 都是正式用詞；因此做為合同翻譯人員，正式用語(yǔ)的使用是一種體現(xiàn)合同翻譯正規(guī)的關(guān)鍵。
